Our client was charged with a Misdemeanor DWI and open container violation in Erie County.  Although the Prosecution, initially, offered a plea to a reduced charge of DWAI (violation), our office critically reviewed all issues related to the allegations and analyzed them through the prism of what the New York Vehicle and Traffic Law requires in order for the Prosecution to prove a DWI beyond a reasonable doubt.

Our office pointed out major flaws in the Prosecution’s case with respect to 1) lack of operation, 2) lack of simultaneous (alleged) intoxication with operation, as well as 3) by also showing that the incident took place on a private driveway, which, in this instance, did not fall under the definition of a “roadway” as is required under New York Vehicle and Traffic Law §1192-7.  Based on the due diligence of our office in investigating these key issues, all charges were dropped.

Our client was charged with (12) B-Felony counts of Criminal Possession of a Controlled Substance and Criminal Possession of a Controlled Substance with Intent to Sell in Niagara County.  Our office was able to negotiate a plea disposition whereas our client, initially, was placed on 1-year of interim probation, during which time he was enrolled in drug court, as well as intensive outpatient drug treatment.  After successfully completing both programs, our office was able to reduce all (12) of the B-Felonies down to (1) Misdemeanor, with no jail time and no probation.
